COMMERCIAL TERMS AND CONDITIONS
KUTRALCO EXPEDICIONES TOURISM AGENCY
Reservations: Any service reservation must be requested in writing via fax or e-mail, and will be considered as CONFIRMED once paid the 100% of the total.
Our prices include: The services are specified in each itinerary, as detailed in the paragraph “The programmes include”.
Our programmes DO NOT include:
- Food, except if it is specified in the programme.
- Transferral is not included.
- Any extra expense in hotels.
- Tips.
- Generally, no extra service or expense non-specified in the programmes.
Note:
- The activities described in our programmes, with possibilities of realization will depend on the weather conditions at the moment of the tour.
Reservations and Payment:
The reservations must have a previous payment of 25% of the total price and confirmed by Kutralco Expeditions, and the balance must be cancelled three weeks before the start of the service(s). Whether the reservation is made less than three weeks of the services start, it must be entirely cancelled (100%).
The reservations can be paid with Credit Card (PayPal), a Bank Deposit in our Current Account or through a Bank Transfer and/or Cash on Delivery via Western Union.
Cancellation and Returns: Because of the numerous stocks of intermediaries (Hotels, Transportation, etc) and required payment deadlines to the travel organizers, it justifies that these factors are more important as the departure date is near. Consequently, because of the Organization, Administration and Reservation expenses, the procedures will be as follows:
A) The programmes including accommodation must be cancelled max. 30 days before since the starting date of the services.
B) The programmes including sea or land transport must be cancelled 30 days before since the starting date of the services.
Note: In both cases (A) and (B), when cancelling the services, the 30% of the total price paid by the Enterprise and involved Enterprises in the cancelled reserves will be retained.
C) When a passenger doesn’t show up the agreed day and hour of departure, will cause the retention of the 100% of the Tour’s total price, no right to replication of money repayment.
D) Once started the travel, the passengers will not have the right to any repayment for quitting excursions, o for travel portions and/or services in case of quit the Tour in any point of the itinerary. Whether, owing to circumstances beyond our control, the Enterprise had to cancel the continuation of already started services, the passenger will have the right of repayment, previously deducting the already used services. In case of not gathering an enough number of inscriptions, solely contracting the responsibility of reinstating the whole of the paid amount to the passenger, no right to complaint and/or compensation.
Date or tour changes: Date or tour changes will be accepted, whenever they are made at least 15 days in advance until the departure date of the initially hired tour, and the correspondent cost of the services involved in the first purchased tour will be charged and fined for cancellation (according to the point “Cancellation and Returns”.
Accommodations: These are the accommodations that will be indicated by the organizer once the information is requested.
A) If the accommodation is not possible in any incorporated establishment in the programmes in cases of force majeure (disasters, strikes, special events, etc), it will be in accommodations of similar category.
B) The arrival to the Hotels is programmed since 12 PM; and the departure, before 11 AM. If the passenger’s arrival occurs before 12 PM, it may happen that the hotel rooms will not be delivered until that moment.
Alterations: The organizer reserves the right to modify the itinerary and/or to alter the schedules, if circumstances of force majeure would force it, for a better organization and development of the Tour. Whether the travel is ought to be extended beyond the stipulated for non-attributable causes to the Enterprise (road interruptions, natural disasters, border closure, etc.). The accommodation and food expenses will be paid by the passenger.
Schedules: The passenger must punctually observe the tour’s departure schedules. If the passenger does not show up in the fixed hour and misses the bus, he/she will pay for the posterior expenses.
Responsibilities: The Operator Agency Kutralco Expeditions, organizer of the described excursions, guarantees the full compliance of the proposed programmes and the services included, but it explicitly declares that solely acts as an intermediary between the passengers and the service providers in the itineraries, such as: Transportation Firms, Hotels, etc. Therefore, the Agency declines all responsibilities caused by faults of the services the providers render. Also, it is not responsible for any damage, wound, accident, robbery, delays or irregularities that could incur during the implementation of services to the persons who travel by their own, as well as the luggage and personal objects.
Luggage or Personal Articles: Kutralco Expeditions will not be responsible for loss of the passengers’ luggage or personal objects, understanding that the passenger is directly responsible of his/her personal objects.
Right of behaviour: If any passenger, due to his/her behaviour, that can be annoying for the rest of the passengers, the guide or driver is authorized to represent his/her behaviour, and in case of recidivism, to ask to quit the excursion. The passenger will not have right to the total or partial repayment.
Note: The Operator Agency reserves the right to refuse admission.
Suggestions and Complaints: Every complaint must be directly made in the offices of Kutralco Expeditions.
Insurance: Insurance is included in the Adventure tours. For other activities, the passengers are requested to hire a travel insurance that covers the activities they would make.
Knowledge of Commercial Terms and Conditions: Once the Tour inscription or purchase is made, it is automatically understood that the costumer is notified of and accepts all the clauses of the actual Commercial Terms and Conditions.
